Terms of Service

By accessing or using Kommit AI ("Kommit," "we," "us," or "our") at getkommit.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

Kommit is a visual spec builder SaaS platform that helps users structure product ideas into production-ready specifications. The Service includes: • A visual canvas for organizing product requirements as connected nodes • AI-powered conversations for extracting structured requirements • PRD (Product Requirements Document) generation and export • GitHub repository integration for codebase context • File upload and asset management capabilities • MCP (Model Context Protocol) integration for AI coding tools We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

To access certain features of the Service, you must register for an account. When you create an account, you agree to: • Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Keep your password secure and confidential • Accept responsibility for all activities that occur under your account • Notify us immediately of any unauthorized use of your account We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

Kommit uses a workspace-based model where each account belongs to one or more organizations. The creator of a workspace is designated as the organization admin and has the ability to invite team members, manage permissions, and configure workspace settings. Organization admins are responsible for ensuring that all members of their workspace comply with these Terms. Actions taken by workspace members may be attributed to the organization.

You agree not to use the Service to: • Violate any applicable laws or regulations • Infringe upon the intellectual property rights of others • Upload or transmit malicious code, viruses, or harmful content • Attempt to gain unauthorized access to the Service or its systems • Interfere with or disrupt the integrity or performance of the Service • Use the Service to develop competing products or services • Reverse engineer, decompile, or disassemble any part of the Service • Use automated means (bots, scrapers) to access the Service without our consent • Generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable We reserve the right to investigate and take appropriate action against anyone who violates this provision, including removing content and terminating accounts.

You retain ownership of all content you submit, post, or display through the Service ("Your Content"), including project specifications, uploaded files, and conversation data. By using the Service, you grant Kommit a limited, non-exclusive license to use, process, and store Your Content solely for the purpose of providing and improving the Service. We will not sell Your Content to third parties. You are responsible for ensuring that Your Content does not violate any third-party rights or applicable laws. You represent that you have the necessary rights to upload and use all content you submit to the Service.

The Service uses artificial intelligence to generate suggestions, structured data, and product requirement documents based on your inputs. You acknowledge that: • AI-generated content may not always be accurate, complete, or suitable for your needs • You are responsible for reviewing and validating all AI-generated content before use • AI-generated content should not be relied upon as professional, legal, or technical advice • We do not guarantee that AI-generated specifications will result in functional software • AI models may be updated, which could affect output quality and consistency You retain ownership of the final output you create using AI-assisted features, subject to any applicable third-party terms.

The Service integrates with third-party services including GitHub, AI providers, and file storage platforms. Your use of these integrations is subject to the respective third-party terms of service. When you connect a GitHub repository, Kommit accesses your code for the purpose of providing contextual AI assistance. We process this data in accordance with our Privacy Policy and do not use your code for training AI models. We are not responsible for the availability, accuracy, or functionality of third-party services. Third-party integrations may be modified or discontinued at any time.

Certain features of the Service may require payment. If you subscribe to a paid plan: • Fees are billed in advance on a monthly or annual basis • All fees are non-refundable except as required by law or as otherwise stated • We may change our fees upon 30 days' prior notice • Failure to pay may result in suspension or termination of your account Free tier access is provided at our discretion and may be subject to usage limits. We reserve the right to modify free tier availability at any time.

The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Kommit and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. Nothing in these Terms grants you any right to use our branding, logos, or trademarks.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may request export of Your Content for up to 30 days following account termination. After this period, we may permanently delete Your Content. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. Kommit does not warrant that the Service will function uninterrupted, secure, or error-free, that defects will be corrected, or that the results obtained from the use of the Service will be accurate or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KOMMIT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: • Your use or inability to use the Service • Any unauthorized access to or alteration of your data • Any third-party conduct on the Service • Any AI-generated content or specifications produced by the Service • Any other matter relating to the Service Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Kommit and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the Netherlands.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
